Question by Kris: Inpatient program while on probation?
I’ve been on probation since August of 2005. This is my 3rd time that I was caught drinking. I tend to relapse around January and it’s only that month I relapse. Also when I relapse I drink about 3 times out of the month. My probation officer wants me to go to inpatient for 28 days. I talked to one counsler and they said I wasn’t criteria for inpatient so now my probation officer wants me to go through the crisis center. The crisis center can hold me up to 14 days. After entering the crisis center and they discharge me saying that I just need outpatient treatment does my PO have to except that or can she make me go to another facility?

    Imaging that your over 17 and depending on your state , sentence, and your original offense, it sounds more like an outpatient basis- if your not leaving anything out. Also, If I thought someone needed inpatient, they would have to be drinking more than 3 times in a month.

    Unless, the probationer originally was ordered (by the judge) to attend an alcohol and drug evaluation and they said the probationer needed inpatient, or I take the probationer back to court and the Judge ordered inpatient treatment, then it remains as outpatient. In the state I work in, a PO can not modify your sentence UNLESS the Judge signs off on the order. In another words, If Alcohol or Drug treatment (in or outpatient) was NOT part of the original sentence, I can not order it. The Judge has to. I can set it up for a hearing- but the Judge has the final say.
